Judicial Panel on Multidistrict Litigation

The Judicial Panel on Multidistrict Litigation, JPML, has agreed to consolidate the Xarelto lawsuits. This consolidation will help to streamline the lawsuits, and allow for an easier decision to be made.
Originally there was a request for Judge David Herndon from Illinois to oversee the Xarelto MDL. This judge was the one that heard the case against Pradaxa, a similar drug thinning drug that causes similar deadly side effects. He approved a $650 million settlement that went to help compensate over 4,000 people that had been injured or killed by this drug.
The JPML decided, however, not to go with Judge Herndon, but rather chose Judge Fallon from New Orleans to oversee the Xarelto MDL. This judge has a great background dealing in MDL cases, and has issued fair verdicts in the past. While the drug companies behind Xarelto are not pleased with the decision, they wanted to prevent the case from going to an MDL in the first place and they also requested that the cases be centralized in New Jersey. Both of those requests didn’t go through.

 

Xarelto Lawsuits

Now that the Xarelto lawsuits have been centralized to an MDL, it is expected that more lawsuits will be filed. The MDL helps to consolidate everything to one judge, so conflicting rulings are minimal. It also helps the witnesses and attorneys representing these cases by reducing the need for multiple trials and multiple hearings. Instead things can be done once, and a decision can be made.
